Kanchan Chatterjee v. State Of West Bengal And ORS.
July 16, 2025 Sl. No.29 Court No.19 s.biswas WPA 15794 of 2025 Kanchan Chatterjee vs.
The State of West Bengal and others Mr. Sabyasachi Chatterjee Mr. Sayan Banerjee Mr. Badrul Karim Ms. Suparna Dutta ... for the petitioner Mr. Supratim Dhar, Sr. Adv.
Ms. Priyanshi Biswas ... for the State
1. On perusal of the entire materials as placed before this court, it reveals that the subject matter of challenge in the instant writ petition is the order dated 7th July, 2025 as passed by the Block Land and Land Reforms Officer, Barrackpore-I, North 24 Parganas, who is an authority under the West Bengal Land Reforms Act, 1955 which is a 'specified Act' under Section 2(r) of the West Bengal Land Reforms and Tenancy Tribunal Act, 1997 (hereinafter referred to as 'the said Act of 1997' in short).
2. Section 6 of the said Act of 1997 clearly mandates that an order made by an authority under the 'specified Act' is subject to jurisdiction of the Tribunal as established under Section 4 of the said Act of 1997.
3. In view of such, this court considers that the instant writ petition is not maintainable before this court.
4. With the aforesaid observation, WPA 15794 of 2025 is dismissed.
5. Before parting with, it is however made clear that the dismissal of the instant writ petition will not prevent the writ petitioner from ventilating his grievance before the appropriate forum, if so advised.
