The petitioner seeks renewal of his passport. A criminal case is pending against the petitioner. 2.

As per the provisions of GSR 570 (E) dated 25th August, 1993 published by the Ministry of External Affairs, an applicant seeking renewal of passport against whom a criminal case is pending is required to obtain an order from the learned Court where the criminal proceeding is pending permitting the applicant to depart the country.

The petitioner has annexed to the writ petition copy of the order dated 10th February, 2025 passed by the learned ACJM, Alipore in Anandapur P.S. Case No. 75 of 2024 that the Court does not have any objection with regard to the renewal of the passport of the petitioner for a period of ten years.

As per the Notification no. 570 (E), specific order permitting the applicant to depart the country is required from the competent court.

It will be open for the petitioner to approach the learned Trial Court for obtaining necessary order in terms of the subject GSR mentioned hereinabove. 6.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
