Despite service and subsequent notice, none appears on behalf of the respondent no.8.

The petitioner alleges that L.R. Plot No.3003 situated at Mouza-Bankra under Bankra-II Gram Panchayat has been used for illegal construction of a market, without conversion of the said land in question.

Ms. Chaudhuri, learned advocate appearing on behalf of the Howrah Zilla Parishad submits that a civil suit is pending in respect of the said property and the petitioner has already obtained an order of injunction. That the Howrah Zilla Parishad has not granted any sanction with regard to any construction on L.R. Plot No.3003.

Under such circumstances, nothing remains to be decided in the writ petition.

The writ petition is accordingly disposed of, in view of the specific stand of the Zilla Parishad.

If the petitioner is aggrieved on account of violation of the injunction order, the petitioner is at liberty to approach

the civil court. The petitioner is also at liberty to approach any other authority with regard to his allegations of illegal conversion.

However, there will be no order as to costs.

All the parties are directed to act on the basis of the learned advocate's communication.
