On prayer of the petitioner liberty is granted to implead the State of West Bengal as respondent No.7 in the writ petition. The cause title of the writ petition be amended accordingly.
Since copy of the writ petition along with all annexures thereto has already been served upon the State respondents, further service is dispensed with. Heard learned counsels for the parties.
The grievance of the petitioner is that the land of the petitioner was acquired and utilized by the Eastern Coalfields Ltd. Mining operation is being carried out in the said land. No compensation has been paid to the petitioner as yet.
The petitioner seeks to submit a comprehensive representation ventilating her grievance before the concerned authority and prays for direction upon the
concerned authority to consider the representation at the earliest.
It is submitted on behalf of the State respondents that the 3rd respondent be directed to consider the representation submitted by the petitioner, in accordance with law.
In view of the above, the writ petition is disposed of with liberty to the petitioner to submit a comprehensive representation before the concerned authority, being the 3rd respondent herein, within 15 days from date. The 3rd respondent is directed to consider and dispose of the representation within a period of three months from the date of receipt thereof after granting reasonable opportunity of hearing to all the interested persons including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. In the event the petitioner is found entitled to compensation, such compensation shall be disbursed in favour of the petitioner within a month thereafter. With the above observations and directions this writ petition being WPA 16495 of 2022 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.
