Report submitted by the learned advocate appearing for the State be kept with the record. The petitioner complains against her driver after he left service and it was alleged that when the vehicle was sent to the service centre, the inspector over there informed her that there was expenditure in repairing the vehicle as the fuel was siphoned off from the said vehicle. To that effect, petitioner tried to establish to contact with her driver being the respondent no.4. However, he had sent his agent who threatened the petitioner. Consequently the petitioner was compelled to lodge information with the police authorities.

State has submitted a report which reflects that steps are taken by Sinthi Police Station. However, as the nature of the accusations complained of lacks materials for establishing cognizable offence, police authorities are not in a position to register any case.

The petitioner, if she is aggrieved, she would approach the jurisdictional court under the relevant provisions of law. Learned Magistrate will exercise

his discretion for either to proceed with the case or not to proceed with the case.

With the aforesaid observations, the writ petition being WPA 16968 of 2024 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
