It appears from the writ petition that the petitioner has lodged a complaint with the Narendrapur Police Station, South 24 Parganas for offences, inter alia, under Section 376 of the IPC against the private respondent no. 4. The 5th respondent is stated to have molested the petitioner.

The 5th respondent is represented before this Court. It is submitted he was arrested and has been enlarged on bail before the Sessions Judge. Investigation is on.

The Narendrapur Police Station, South 24 Parganas has submitted instructions dated September 7, 2022, addressed to the learned Government Pleader.

It appears from the instructions that the petitioner's apprehensions are incorrect. An FIR has been registered being Narendrapur PS Case

No. 769/22 dated 12.07.2022 under Sections 417/376/354B/506/34 of the IPC.

The 4th respondent-principal accused is absconding and the police are continuing with the investigation. Steps are indeed being taken to apprehend the 4th respondent by conducting repeated raid, inter alia, under Basanti Police Station.

The report of the Narendrapur Police Station, South 24 Parganas in the form of instructions, addressed to the State Advocate, is taken on record.

It appears from the submissions of the learned counsel for the private respondent that the allegations of the petitioner are ex facie incorrect. As on July 18, 2022, the petitioner herself has given a statement before the learned Magistrate under Section 164 of the Cr. P.C. It is ordered that the investigation into the FIR is completed as expeditiously as possible.

In view of the above, nothing remains to be adjudicated in the writ petition and is, therefore, disposed of without any order.

There shall be no order as to costs.
