The contempt petition does not disclose any material from which we could find out any breach of undertaking. Apart from bold statement no material has been disclosed to show that the alleged contemnor has failed to pay the educational expenses of the son and that Mr. Debdip Ghosh was shifted from 'Empathy Foundation' to 'Antara' in Baruipur or 'Little Hut Nirikhon Kendra' on VIP Road as suggested by Dr. Rima Mukherji.

2. Mr. Joydip Ghosh has in the affidavit stated that he is going to incur all educational expenses as per recommendation of Dr. Rima Mukherji. In absence of any document showing that the petitioner has breached any such undertaking by the alleged contemnor. We are unable to proceed with the matter.

3. Accordingly, the contempt application, is dismissed.

4. This order, however, shall not prevent to the petition to make appropriate application with proper and better particulars or initiate

any independent proceeding for the maintenance of the son Debdip Ghosh in accordance with law.
