Mr. Tulsi Das Maiti ...for the petitioner Mr. Shuvro Prakash Lahiri ...for the State Matter is heard in presence of the learned advocates representing the petitioner and the State-respondents. However, in spite of service of notice authority of Ambikapur Altaf Hussian High School (HS) North 24 Parganas being respondent nos. 5 and 6 are not represented.
Learned advocate representing the State respondents submits that there was no fault on the part of the State respondents in releasing provident fund in favour of the petitioner but due to laches on the part of the school authority in taking steps within time provident fund dues could not be paid to the petitioner. In support of such submission letter of the Headmaster of Ambikapur Altaf Hussian High School (HS) North 24 Parganas dated 10th April, 2025 is placed before this Court and same is taken on record. It is also stated in the letter dated 10th April, 2025
that petitioner applied for withdrawal of provident fund dues in February, 2024. However, it is stated in the said letter that the issue is resolved and the school authority is taking steps for release of provident fund immediately.
In view of letter dated 10th April, 2025 of the headmaster of the aforesaid school and the submission made on behalf of the State respondents as well as the petitioner, writ petition stands disposed of directing the authority of Ambikapur Altaf Hussian High School (HS) North 24 Parganas being respondent nos. 5 and 6 as well as District Inspector of Schools (SE) North 24 Parganas being respondent no. 3 to release provident fund dues in favour of the petitioner with statutory interest by 10 (ten) days from the date of communication of this order.
Learned advocate for the petitioner is granted leave to communicate server copy of the order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
