The limited prayer of the petitioner is for consideration of an application made for a fresh licence under Bengal Excise Act, 1909. The prayer made verbally for refund of the amount invested by the petitioner for purchase of foreign liquor before the licence was suspended in 2019.
Since the writ petition does not reflect the second prayer, the respondent authorities being the State respondents are directed to consider the application of the petitioner dated 22nd September, 2021 and dispose of the same within eight weeks from date by way of a reasoned order upon hearing all necessary parties including the petitioner. The petitioner shall be informed by the authorities within one week from which such decision is taken.
Both parties rely on an order passed by a Coordinate Bench in W.P.1581 of 2020 (Sadhu Mirdha & others Vs. The State of West Bengal & ors.) where the petitioners before the court were found to be entitled to apply for a fresh licence upon full compliance of required formalities and the authorities were directed to dispose of the same.
W.P.A.17279 of 2021 is disposed of in terms of the above.
