A.G.P., Mr. Sougata Mitra ....for the State The petitioner complains that her elder daughter and son are harassing her. Admittedly, the elder daughter and son have been gifted the entire property in question by the petitioner's husband. The dispute arose when the petitioner objected to the transfer of a water connection in favour of the elder daughter and son.

This Court's mind is not free from doubt that this proceeding has been instituted at the instance of the younger daughter and the petitioner is mere front to the said daughter's vendetta.

Be that as it may, the private respondents are obliged to maintain the petitioner. The petitioner shall not take sides and reside in the said premises peacefully.

The Officer-in-Charge, Ghola Police Station, North 24 Parganas, being respondent no.5, shall

maintain a strict vigil on the property and warn all parties to ensure that there is no breach of peace. It is submitted that there is a civil suit being T.S. No. 299 of 2021 pending before the Civil Judge (Junior Division), 2nd Court, Barrackpore.

The complaint of the petitioner dated June 8, 2022, has also resulted in a charge sheet being Ghola PS Case No. 315/2020 dated 30.06.2022 under Sections 341/323/34 of the IPC and Section 24 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

It is clear from the above that the Ghola Police Station has taken all steps in accordance with law on the complaint of the petitioner. There is no inaction on the part of the police.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

The report of the Ghola Police Station, Barrackpore Police Commissionerate dated 08.08.2022 is kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
