Report submitted by the State is taken on record. The petitioner prays for return of his vehicle bearing registration no. WB33A-8726 which was seized in connection with UR case no. 10 of 2023 alleging commission of offence punishable under Section 59A of the Indian Forest Act.

It appears from the report submitted by the State that the seized vehicle was not carrying forest produce and no confiscation proceeding has been initiated in respect of the said vehicle. The report also indicates that the case does not fall under Section 59A of the Indian Forest Act. It is also not in dispute that the petitioner is the registered owner of the vehicle.

In view of the above, further detention of the vehicle by the prosecution is not required.

The vehicle bearing registration no.WB33A-8726 be returned to the petitioner by the Forest Beat Officer/concerned officer within seven days from date upon the petitioner furnishing bond of Rs.12 lakhs and on condition that the petitioner shall not transfer/alienate the vehicle to any third person and shall not change the nature,

character and colour of the vehicle without permission of the learned trial Court and shall produce the vehicle before the learned trial Court as and when called for.

CRR 2721 of 2024 and the connected application being CRAN 1 of 2024 are disposed of.
