The petitioner is aggrieved by the fact that in spite of informing the police authorities, no steps are being taken and the petitioner is facing inconveniences as he is unable to enter his land nor he is able to raise the boundary wall.

Learned advocate appearing for the State submits that a long standing land dispute is existing between the petitioner and the private respondents. Proceedings have been drawn up under Section 163 of BNSS at the behest of the petitioner. Several G.D. Entries were recorded by the police authorities.

However, the police authorities could not interfere for a long standing civil dispute/land dispute existing between the petitioner and the private respondents.

So far as right, title, interest and issues regarding boundary or demarcation of a property is concerned, the same would be decided by the civil court and the police authorities will not interfere on such issues. However, the police authorities would

continue their surveillance and ensure that no breach of the peace or tranquility takes place at the locale and/or any untoward incident results because of the inimical relationship existing between the petitioner and the private respondents. With the aforesaid observations, the writ petition being WPA 16148 of 2025 is disposed of. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
