Mr. Partha Pratim Roy, Mr. Arunava Maiti ... for the petitioner Ms. Debarati Sen (Bose) ... for the State The petitioner is aggrieved by the inaction on the part of the respondent no. 11 being the Additional District Sub-Registrar, Narayangarh, Paschim Medinipur in registering a deed of the petitioner executed on 9th June, 1998. The petitioner requires the deed on an urgent basis by reason of a pending case of pre-emption where the petitioner is the applicant. The petitioner accordingly made a representation before the concerned authorities on 30th March, 2021 to which there has been no response from the authorities. The only document given by the Jt. Inspector General of Registration, West Bengal dated 1st July, 2013 is that the petitioner is neither an executor nor an executee of the concerned deed.

According to learned counsel, the petitioner can be neither since the petitioner is the pre-emptor in the application.

Whatever may be the merits of the case, there is no reason why the application for registration has been kept pending since 1998 by the Additional District SubRegistrar, Narayangarh. The State is represented.

WPA 17298 of 2021 is disposed of with a direction on the respondent no. 11 to take necessary steps with regard to the registration of the deed within three weeks from today. The petitioner shall be communicated with the order not beyond the outer limit of four weeks from today.
