Re : IA No.: CRAN/1/2021 This is an application under Section 5 of the Limitation Act filed by the appellant praying for condonation of delay of 568 days in preferring the special leave to appeal against the judgment and order dated 18th January, 2020 passed in G.R. Case No. 2344/2016.

The learned advocate for the petitioner appears in virtual mode. Ms. Faria Hossain, learned advocate for the State appears for the opposite party.

Having heard the learned counsels for the parties and on perusal of the petition under Section 5 of the Limitation Act I find that the petitioner has been able to make out a sufficient ground as to delay in filing the special leave to appeal. Since the delay has been properly explained, the same is condoned. The application under Section 5 of the Limitation Act is allowed.

Re : CRMSPL 27 of 2021 This is an application for special leave to appeal filed by the appellant against the judgment and order of acquittal passed by the learned Additional Sessions Judge, Fast Track, 2nd Court, Howrah in Sessions Trial No. 189/2017.

Special Leave to appeal is allowed.

The appellant is directed to file memorandum of appeal within 30 days from the date of this order.
