Learned counsel for the petitioners submits that the petitioners' application under Section 14 of the SARFAESI Act, 2002 has been kept pending beyond the statutory period.

The affidavit-of-service and receipt of service of notice of upgradation filed in court today be kept on record.

WPA 16106 of 2023 is disposed of by directing the District Magistrate, North 24 Parganas at Barasat to dispose of the petitioners' application under Section 14 of the SARFAESI Act as expeditiously as possible, preferably within three weeks from the date of communication of this order to the said District Magistrate.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
