Mr. D. N. Chatterjee, Mr. Murari Chakraboty, Mr. Mahesh Kumar Shaw ... For the private Respondents in both matters. On the prayer of the learned advocate appearing for the petitioners, both the writ petitions are taken up for consideration.

Petitioners and the private respondents in both the writ petitions are at loggerhead and they are acquainted with each other. From the averment in the writ petition, it is found that the subjectmatter involves occupying certain rooms of 158/3, Baithak Khana Road, Raja Ram Mohan Sarani, Kolkata-700009. Petitioners are aggrieved by the interference of the private respondents with their peaceful enjoyment of the property.

So far as the interference of the private respondents is concerned, information was furnished with the Officer-in-Charge of Muchipara Police Station.

Learned advocates for the State in both the writ petitions have submitted their reports, which reflect that the petitioners in WPA 16021 of 2025 and WPA 16022 of 2025 are cousin brother and sisters who have instituted the present writ petitions for the same set of accusations. Primarily the police authorities on enquiry have come to a finding that the petitioners are intending to sell the property and as such with that end in view are hoping to vacate the property.

Having considered the reports so submitted in both the writ petitions, I am of the view that prima facie no case has been made out for interference by the police authorities. If the petitioners have specific accusation, then in that case the petitioners would approach the jurisdictional court for which specific prayer be advanced before the concerned court which will assess and ascertain the accusations and thereafter pass necessary directions as it deems fit and proper.

Affidavit-of-service filed in Court today be kept with the record.

Reports submitted by the learned advocates appearing for the State be also kept with the record. With the aforesaid observations, the writ petitions being WPA 16021 of 2025 and WPA 16022 of 2025 are disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
