The present revisional application was preferred challenging the order dated 17.02.2023 passed by learned Sessions Judge, Paschim Medinipur in Criminal Revision No. 121 of 2023 wherein judgement and order dated 18.01.2023 passed by learned Additional Chief Judicial Magistrate, Kharagpur in M. R. Case No. 40 of 2020 was challenged. Records reflect that the learned Additional Chief Judicial Magistrate, Kharagpur was pleased to award a sum of Rs.8000/- per month to the wife and another sum of Rs.8000/- per month to the minor son aggregating to a sum of Rs.16000/- per month to be paid by the present petitioner. Challenging such order, the petitioner preferred a revisional application before the learned Sessions Judge, Paschim Medinipur. The learned Sessions Judge by his order dated 17.02.2023 was pleased to refuse any order relating to stay and fixed subsequent dates on 18.04.2023 and 18.07.2023. It has been informed that the next date has been fixed before the learned revisional court on 12.03.2024.

Mr. Ali, learned advocate appearing for the petitioner expresses anxiety regarding the execution case and its processes which have been issued.

Since the revisional application is still pending and the learned Sessions Judge, Paschim Medinipur is in seisin of the matter, I direct that any application in connection with grievance arising from the execution proceedings may be filed in connection with Criminal Revision No. 121 of 2023. If such an application is preferred, the learned Sessions Judge would consider the same in accordance with law. It is further directed that so far as the main revisional application is concerned, the learned revisional court would take efforts to conclude the hearing of the same and pronounce its verdict by 15.05.2024.

With the aforesaid observations, the revisional application being CRR 2488 of 2023 along with the connected applications is disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
