Matter is heard in presence of learned advocates representing the petitioner and Port Authorities. 2.

Writ petition being WPA 9353 of 2020 was filed by the petitioner claiming benefit of pension and family pension. Husband of the petitioner died on 20th November, 2013.

Since husband remained unauthorizedly absent on and from 17th September, 2001 on initiating proceeding against the husband order of compulsory retirement was passed on 20th July, 2004 with immediate effect.

Aforesaid writ petition being WPA 9353 of 2020 was disposed of by a coordinate Bench vide order dated 21st December, 2020 wherein it was held that claim

of the petitioner for grant of pension/family pension could not be accepted as in terms of relevant rules relating to pension of employees of port authorities until and unless an employee completes ten years of qualifying service he will not be entitled to receive any pension.

In the present case nothing has been demonstrated that husband of the petitioner rendered requisite period of ten years service in order to receive pension. Moreover, in terms of order dated 21st December, 2020 passed by the coordinate Bench a decision has been taken by the Senior Deputy Manager (P & IR), Syama Prasad Mookerjee Port, Kolkata on 1st November, 2021 whereby prayer of the petitioner for sanction of pension /family pension was rejected on certain grounds delineated therein. A copy of said order dated 1st November, 2021 is placed before this Court and same is taken on record.

In the present writ petition order dated 1st November, 2021 is not under challenge.

Hence, no relief can be granted to the petitioner. 7.

Writ petition stands dismissed.

There shall be no order as to costs.
