Learned advocate appearing for the petitioner submits that the case was registered in the year 2014 and subsequently chargesheet, on completion of investigation, was filed on 30th November, 2014. According to the petitioner, charge was framed on 16th October, 2017 and till date, no witness has been examined in this case. Having regard to the Covid-19 Pandemic which compelled the court to operate in a staggered manner, I am of the view that full responsibility cannot be justified on any
of the parties. However, having regard to the fact that more than 6 years have passed since the institution of the case, the complainant is entitled to some directions.
Accordingly, the learned Judicial Magistrate, 2nd Court, Barrackpore is directed to fix at least one day in each and every sixty days and take the trial to its logical conclusion within a reasonable period of time. It is further submitted that no unnecessary adjournments should be granted to either of the parties and the Public Prosecutor conducting the case should assure the court regarding the availability of the witnesses on the dates so fixed. All efforts must be taken by the court keeping in mind that the charge was framed in this case for the cruelty inflicted because of the demand of dowry.
With the aforesaid observations, the criminal revisional jurisdiction being CRR 2192 of 2021 disposed of. All parties are to act on the server copy of this order duly downloaded from the official website of this court. ( Tirthankar Ghosh, J. )
