In the Matter of : Rakesh Singh .....petitioner.

Mr. Suman Chakraborty ...for the petitioner. Mr. Rudradipta Nandy, Ms. Sonali Das ...for the State. This ponzi scam is of 2014. The petitioner is one of the principal accused but according to learned counsel for the State he absconded for eight years and finally surrendered to the authorities in 2022.

He is in custody for 134 days. Investigation is over. Charge-sheet has been submitted.

Learned counsel for the State very rightly submitted that whatever damage he could do, the petitioner has done in these eight years.

We only express our desire that the prosecution be conducted as early as possible so that the trial is concluded within reasonable time.

But on the above facts, we have to allow this application for bail.

The petitioner will be enlarged on bail upon furnishing a bond of Rs. 10,000/- (Ten Thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Special Court-cum-Additional Sessions Judge, 1st Court, Hooghly Sadar on the following conditions:

1. The petitioner shall deposit his passport, if any with the investigating officer,

2. He shall report before the said officer as and when summoned,

3. The petitioner shall not leave the limits of Paschim Bardhaman without informing the I.C.,

4. He shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever,

5. The petitioner shall attend the court on each and every day of trial, in default, the court shall be at liberty to cancel the bail bond without any reference to this bench.

The application for bail [CRM (DB) 2468 of 2022] is, accordingly, disposed of.
