The contemnor No.4, Shri Debanjan Chakravarty is personally present in Court. The explanation offered for the delay of three years in not disposing the application of the 9th respondent is evasive and not satisfactory.

This Court's mind is not free from doubt that the 9th respondent was allowed to make undue gain by reason of the delay in disposal of the application. The matter calls for appropriate proceedings and an enquiry against Shri Debanjan Chakravarty, the Senior Examiner of Trade Marks and GI, Kolkata.

Let this order be served on the Controller General of Patents, Designs & Trade Marks for considering the appropriate action in accordance with law.

The contemnor No.4 shall dispose of the application of the 9th respondent within a period of one month from date mandatorily and positively and submit a report to the Controller General of Patents, Designs & Trade Marks in terms of this order. The contempt application shall stand disposed of.

Rule, if any, shall stand discharged.

There will be no order as to costs.

Interim orders, if any, shall stand vacated.
