Banerjee) Ms. Labanyashree Sinha ... for the petitioner Learned advocate appearing for the petitioner submits that the petitioner filed an application under Section 9 of the Arbitration and Conciliation Act and the learned District Judge, Purba Bardhaman by an order dated June 21, 2025, directed the petitioner to issue notice upon the opposite parties and July 23, 2025 has been fixed for service returns and acknowledgement due.

Learned advocate appearing for the petitioner submits that in compliance with the said order, the notice has already been served upon the opposite party. She further submits that though an application under Order 39 Rule 1 and 2 of the Civil Procedure Code was filed, the petitioner has instructed the learned advocate to submit that the petitioner shall not press the application under Order 39 Rule 1 and 2 of the Civil Procedure Code but shall proceed with

the application under Section 9 of the Arbitration and Conciliation Act.

Such submission of the learned advocate appearing for the petitioner is placed on record. Considering the fact that July 23, 2025 has been fixed by the learned District Judge, this court is not inclined to interfere with such order.

With the above observation, CO 2564 of 2025 stands disposed of.
