Learned advocate appearing for the petitioner submits that similarly placed accused persons have been granted bail in CRM (NDPS) 1424 of 2025.

Learned advocate appearing for the State opposes the prayer for bail and submits that there is a distinctive feature in the present case as against the present petitioner there is another case where recovery has been effected. Learned advocate for the petitioner submits that in the said case petitioner has been granted bail by the Hon'ble Apex Court in Special Leave to Appeal (Crl.) no. 13050/2025. Having regard to the period of detention of the present petitioner and there being no recovery in the present case, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed.

As such the petitioner namely, Subhas Sil shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Special Judge under NDPS Act, Hooghly.

If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case. The petitioner shall meet with the Inspector-in-Charge of Bhadreshwar Police Station once in a fortnight until and unless the same is modified by the learned Special Court. Accordingly, CRM (NDPS) No. 908 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
