1. By way of filing this public interest litigation the petitioners allege that the land which is comprised in Dag No.457 in Mouza-Faridpur, JL No.227 measuring about 44 decimal, which is classified as "Samsan" and recorded in KhatianNo.1 in favour of Collector, Government of West Bengal is being put to use for the purpose of constructing shops to form a gold hub. The record of right shows that the beneficiary is MSME. It is not clear as to how a government land, which is classified as a crematorium land, can have a private beneficiary.

2. Therefore, we direct the learned District Magistrate, Paschim Medinipore, the third respondent to immediately enquire into the matter and if the name of the beneficiary has been wrongly entered into then after notice to all concerned, necessary rectification should be made so that the land, which has been earmarked as a crematorium land, shall be retained as crematorium land without altering its basic features. This direction be complied with by the learned District Magistrate, Paschim Medinipore within a

period of three weeks from receipt of the date of server copy of this order.

3. With the above observations, the instant writ petition stands disposed of.
