The petitioners claim incentives in terms of the Incentive Scheme -2013 as modified. The petitioners are aggrieved by a communication of 08.07.2022 from the General Manager, District Industries Centre, North 24-Parganas by which the entire process of assessing the eligibility of the enterprise has been kept pending.

The impugned communication states that the eligibility status of the petitioners is to be ascertained under the concerned Scheme. The authorities have not given any further particulars or indication as to what assessment involves or the projected time period.

The State authorities are represented.

WPA 16588 of 2022 is disposed of with a direction on the respondent no. 2 being the General Manager, District Industries Centre, North 24 - Parganas to complete the assessment of the eligibility process of the petitioners within a period of three weeks from the date of communication of this order. A copy of the decision shall be communicated to the petitioners within a week from the date on which such decision is taken.

The impugned communication dated 8th July, 2022 is set aside.

The respondent authority shall be at liberty of inspecting the factory of the petitioners if so required.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
