1) Affidavit of service filed on behalf of the petitioner is taken on record.

2) Petitioner is an approved Headmaster who will retire on 30th April, 2026. It is contended on behalf of the petitioner that on submission of pension papers of the petitioner steps are being taken for calculation of excess drawn amount and attention of this Court has been drawn to a document at page 30 of the writ petition wherein concerned State respondent has stated fixation of pay of Headmaster may be rectified and if excess drawn amount is found that may be deposited. However, till date calculation is not complete relating to fixation of pay of the petitioner for processing pension case.

3) At this premature stage Court is not inclined to interfere with the process of calculation of pay of the petitioner which is necessary for finalizing pension case.

4) Respondents are directed to complete the pay fixation at an early date and communicate the same to the petitioner. If petitioner is aggrieved by pay fixation leave is granted to the petitioner to take steps in accordance with law.

5) Writ petition stands disposed of.

6) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
