Mr. Debjit Mukherjee Mr. Kaustav Bhattacharya Ms. Priyanka Jana ... for the petitioner Mr. Gopal Krishna Karmakar ..the opposite party no.1 (in person) This application under Article of the Constitution of India is at the instance of the defendant no.1 praying for a direction upon the learned Civil Judge (Junior Division), 1st Court at Barasat to dispose of the application under Order 39 Rule 1 and 2 filed in Title Suit No. 745 of 2024 expeditiously.

When this matter is taken up for hearing Mr. Gopal Krishna Karmakar appears in person. He submits that by an order dated 24th June, 2025 the application under Order 39 Rule 4 of the Code of Civil Procedure filed by the petitioner herein stood rejected.

From the order-sheets appended to this application this Court finds that 19th November, 2025 has been fixed for hearing of the temporary injunction application. Mr. Mukherjee, learned advocate appearing for the petitioner submits that on 3rd July, 2024 the written

objection to the temporary injunction application has already been filed and the injunction application is otherwise ready for hearing.

In the light of the submissions made by the learned advocate for the petitioner and the opposite party no.1 appearing in person, C.O. 2566 of 2025 stands disposed of by requesting the learned Civil Judge (Junior Division), 1st Court at Barasat to take up the hearing of the application for temporary injunction application on 19th November, 2025, if the same is otherwise ready for hearing, and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
