August 26, 2025 24 ARDR (Rejected) CRM (M) 1086 of 2025 In Re : An Application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Khargram Police Station Case No. 297 of 2023 dated 10/8/2023 under Sections 143/341/325/326/307/302/120B of the Indian Penal Code and Sections 25/27 of the Arms Act.

And In Re :

Kawsar Sk @ Kaosar ... Petitioner.

Adv. Jaydeep Biswas, Adv. Tapodip Gupta, ... for the petitioner.

Adv. Sompurna Chatterjee, ...for the de facto complainant.

Adv. Antarikhya Basu, Adv. Sarthak Mondal ...for the State.

Report submitted by the State is taken on record. Heard learned counsels for the parties.

Learned counsel for the petitioner has referred to the evidence of PW 7 and PW 8 and has submitted that these two witnesses were not present at the place of occurrence and cannot be termed as eye witnesses. Their evidence cannot lend support to the prosecution case.

Learned counsel for the State opposes the prayer. In turning down the bail prayer of the petitioner on two earlier occasions on 10th July, 2024 and 7th March, 2025, this Court has dealt with the material on record including deposition of seven witnesses examined by the prosecution. There is no change in circumstance of the case which warrants a favourable order for the petitioner at this stage.

Learned counsel for the State submits that the prosecution proposes to examine eleven more witnesses.

In view of the above, the bail prayer of the petitioner is rejected at this stage.

The application for bail is disposed of.

Case Diary be returned.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
