Sri Sambhu Bardhan Mr. Krishnendu Bera ...for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Div.) at Bidhannagar to dispose of the Title Suit No.140 of 2019 expeditiously.

The learned advocate appearing for the petitioner submits that this is a suit for eviction under Section 2(g) of the West Bengal Premises Tenancy Act, 1997 and in such a suit the opposite party herein filed an application under Section 7(2) of the 1997 Act which is pending for a long time.

In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or the learned advocates representing the opposite party before the learned trial judge. In the light of the submission made by the learned advocate for the petitioner, CO 2568 of 2025 stands

disposed of by requesting the learned Civil Judge (Jr. Div.) at Bidhannagar to make an endeavour to dispose of the application under Section 7(2) of the 1997 Act as expeditiously as possible without granting any unnecessary adjournments to either of the parties. After disposal of the application under Section 7(2) of the 1997 Act and other interlocutory applications the learned trial judge shall make an endeavour to dispose of the suit expeditiously.

There will be no order as to costs.
