This is an application for quashing of a proceeding in G.R. Case No. 816 of 2025 pending before the learned Judicial Magistrate, 6th Court, Alipore, South 24 Parganas arising out of Kasba Police

Station Case No. 413 dated 26.12.2024 in which a charge sheet has now been submitted under Sections 448, 506 and 34 of the Penal Code.

Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are the daughter and the son in law of the de facto complainant opposite party no.2. All disputes that had led to the registration of the FIR have been settled between the private parties and as such, the impugned proceeding ought to be quashed.

Learned counsel appearing on behalf of the de facto complainant supports such contention of the petitioners and submits that a settlement has indeed been arrived at between the private parties.

Learned counsel appearing on behalf of the State relies on the report and the case diary and submits that this is a strange case where in a subsequent statement the victim has set out the factual backdrop in which she lodged the FIR. However, at the end she stated that she had settled the matter with the petitioners. It does not appear that there is any injury report present in the case diary. It appears that a settlement has been arrived at between the private parties of all disputes that had led to the initiation of the impugned proceeding.

In view of the above, I hereby quash the impugned proceeding on the ground of settlement and compromise.

The revisional application and CRAN 1 of 2025 are disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities. (Jay Sengupta, J.) ssi
