Learned counsels for the petitioner and the private opposite party submit that the dispute has been amicably settled between the parties and the private opposite party does not intend to proceed with the matter any further. The statement of the private opposite party recorded under Section 161 of the Code of Civil Procedure by the Inspector in charge, Bidhannagar East Police Station also corroborates the said submission. However, learned counsel for the State points out that several other cases are pending against the petitioner and the antecedent of the petitioner is not very praiseworthy. Further, the petitioner demanded money from the private opposite party upon brandishing gun which may be termed as heinous offence.
The complaint was filed as a result of a private dispute between the parties and the allegations levelled against the petitioner were
under Section 25(1) AA of the Arms Act read with Section 387/447 of the Indian Penal Code.
Since the parties have settled the matter amicably and the private opposite party does not intend to proceed with the matter any further, this Court is of the view that the matter may be disposed of on such count since continuation of the proceedings shall only be a futile exercise.
The revisional application, being CRR 2731 of 2024 and the connected application are allowed.
Proceedings of G.R. case no. 434 of 2023 pending before the learned Additional Chief Judicial Magistrate, Bidhannagar, North 24 Parganas be quashed.
