Learned senior advocate appearing on behalf of the petitioner is aggrieved by the inaction of the police authorities as he was restrained from carrying out his business of building materials, since on 23.06.2023 about three or four persons came to the scheduled plot of land referred to in the writ petition and threatened him. State has submitted a report dated 25.07.22023 which reflects that at the relevant point of time proceedings were drawn up under Sections 107/116(C) of Cr.P.C. against both the parties.

Having considered that the representation was made with the Officer-in-Charge, Gushkara police station on or about 27.06.2023 and the police report is of 25.07.2023 and in the meantime more than one and half years have passed, I direct that if the situation till date persists, the petitioner would file a fresh representation

before the Officer-in-Charge, Gushkara police station. The concerned Officer-in-Charge will assess as to whether the issue relating to peace and tranquility is questionable and ensure no untoward incident results because of the strained relationship existing between the parties. With the aforesaid observations WPA 16153 of 2023 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
