The petitioner herein is a holder of a permanent stage carriage permit for the route Krishnagar to Berhampur via Mahishbathan, Gopalpurghat, Jalangi, Domkal and the said permit was issued against Vehicle bearing No. WB-51-1743. Main grievance of the petitioner is with regard to the objection raised by the private respondents to ply his vehicle on the said route particularly on and from Krishnagar to Berhampur for which he is facing financial loss due to non-covering of the entire route i.e. Krishnagar to Berhampur as per approved time table. The learned Counsel appearing for the private respondent submits that there is an approved time table which the vehicle owner are bound to comply.

The petitioner is plying his vehicle in contravention to the approved time table.

Having heard the parties and upon considering the materials available on record I am of the considered view that a proper independent enquiry is required to be caused in order to ascertain whether the petitioner is at all running the vehicle in the said route i.e. from Krishnagar to Berhampur beyond the approved time table or not. The petitioner has made a representation before the authority concerned on 02.06.2025 which remains unanswered.

I direct the respondent no. 4 to consider the representation dated 02.06.2025 at page 23 of the writ petition within a fortnight and pass a reasoned order in accordance with law upon affording opportunity of hearing to the interested parties. The said order shall be communicated by the respondent no. 4 accordingly to the interested parties.

The writ petition is disposed of without taking any exception to the merits of this case. It is needless to mention that the respondent no. 4 shall arrive at a logical stand and shall take necessary steps forthwith in accordance with law.
