The petitioner is aggrieved by the inaction of the police authorities particularly with regard to the manner in which investigation has been progressing in connection with Barasat Police Station Case No. 292 of 2025 dated 09.06.2025. Mr.

Chatterjee, learned senior advocate appearing for the petitioner submits that the case was registered under Sections 111/3(5)/316(2)/ 318(4)/336(3)/61(2) of BNS, 2023. According to the learned senior advocate, 'Sasthya Sathi Scheme' of the State Government is being misutilised by some of the hospitals in an organised manner. As such, the petitioner was compelled to set the criminal law into motion.

Learned advocate appearing for the State submits that the investigation has commenced on 09.06.2025 and the same is in progress.

Having regard to the time frame provided under the present BNSS, 2023, I direct the police authorities to hand over a progress report after the statutory period of 90 days is over. In case the petitioner is aggrieved by the progress of the investigation after the statutory period of 90 days, petitioner would approach the jurisdictional Magistrate and thereafter exhaust the remedies in respect of the deficiencies complained of or the materials collected in course of the investigation. However, the police authorities are further directed that they would put in their efforts to unearth the truth particularly with regard to the accusations made by the informant in respect of some of the hospitals against whom complaint has been made. With the aforesaid observations, the writ petition being WPA 16113 of 2025 is disposed of. There will be no order as to costs.
