27.07.2022 sdas rejected C.R.M.(NDPS) No. 843 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Raghunathganj Police Station Case No. 405 of 2019 dated 09.08.2019 under Section 21(b)/29 of the NDPS Act.

And In Re : Allauddin Sk. & Anr. .... petitioners Ms. Minoti Gomes ....for the petitioners Heard learned Counsel appearing for the petitioners. We have considered the materials on record. Statements of witnesses and seizure memorandum show recovery of 172 kgs. of Ganja from the petitioners. Under such circumstances and in view of statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioners. The application for bail is, thus, rejected.

Trial court is directed to expedite the trial and conclude the same at an early date preferably within six months from the next date fixed for recording evidence without granting unnecessary adjournment to either of the parties. (Ananya Bandyopadhyay, J.) (Joymalya Bagchi, J.)
