Ms. Das, learned advocate, appears for the petitioner and prays for an accommodation.

The subject matter of the revisional application relates to an order dated 16th September, 2003 passed by the learned SubDivisional Judicial Magistrate, Alipore, 24 Parganas (South) in Case No.C/5161/03.

I have perused the order dated 16th September, 2003 and I find that subsequent to the said order, case was registered by Karaya Police Station being Karaya Police Station Case No.272 dated 19.09.2003 (C.G.R. No.2718 of 2003).

As none appears on behalf of the State, Ms. Baisali Basu, learned advocate, who ordinarily appears on behalf of the State, is directed to represent the State. Her appearance may be regularised by the concerned authorities.

Having regard to the fact that the revisional application has not been admitted till date and Karaya Police Station registered the case and proceeded with the investigation, the very substance of

challenge of the order dated 16th September, 2003 becomes infructuous. As such, I am of the opinion that no interference is called for in respect of the prayers advanced in this revisional application.

Accordingly, CRR 2283 of 2003 is dismissed.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
