The petitioner is seeking release on bail. It is pointed out that due to misunderstanding between the petitioner and his deceased wife, she committed suicide by hanging. This is for the first time that the petitioner has sought for grant of bail after his arrest and then he is in jail custody for last six months. Heard learned Advocate for the petitioner. The learned Advocate for the State places the case diary and contends that just after three years of marriage, since there was demand of more dowry, the victim lady committed suicide. It would appear that no physical assault was inflicted by the petitioner / husband on his deceased wife. The victim lady left behind her one and half years old baby.

Having regard to the facts of the case as transpired from the case diary and upon hearing the learned Advocate for the parties, the petitioner be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only) with two sureties of like amount each, one of whom must be local, to the satisfaction of the Learned Additional Chief Judicial Magistrate, Chanchal, Malda. CRM 6860 of 2021 is allowed and disposed of on the above basis.
