Learned advocate appearing for the Durgapur Municipal Corporation draws the attention of this Court to the provisions of Section 266 of the West Bengal Municipal Corporation Act, 2006 and submits that in view of the statutory requirements the representation dated September 27, 2021 should be considered by the Commissioner of the said municipality and not the Chairman.

The order dated 27.10.2021 is accordingly modified to the extent that the Commissioner of the Durgapur Municipal Corporation would dispose of the representation dated September 27, 2021 by 15th January, 2022 after informing all the parties regarding the date fixed for hearing.

The above modification may be treated as part and parcel of the original order dated 27.10.2021.
