10.12.2021 tkm/ct 28 C.R.M. 6864 of 2021 sl no. 101 In Re : An application for bail under section 439 of the Code of Criminal Procedure in connection with Patashpur PS case no. 100/2020 dated 25.2.2020 under sections 392/397/302/34 of the IPC And In Re : Reyajul @ Chand ........ petitioner Mr. A K Samanta ...... for the petitioner Mr. M Sur Mr. Pratick Bose ...... for the State Petitioner is in custody for more than 600 days and it is submitted that co-accused Nure Alam is on bail. Learned lawyer for the State opposes the prayer for bail and submits that the petitioner has been identified by witnesses in the course of TI parade.

We have considered materials on record. Petitioner has been identified by eye-witness in the course of TI parade. Hence, he does not stand on the same footing with Nure Alam who has been enlarged on bail.

In view of the aforesaid materials on record disclosing prima facie involvement of the petitioner in the alleged crime and the gravity of the offence, we are not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail is rejected. (Bivas Pattanayak, J.) (Joymalya Bagchi, J.)
