1. Affidavit of service filed in Court today is taken on record.

2. The petitioner prays for a direction upon the Regional Provident Fund Commissioner, Kolkata-I to release his Provident Fund dues.

3. From the documents annexed to the writ petition, it appears that both the employer and the employee's contribution of Provident Fund have been deposited before the competent authority. The same is required to be disbursed in favour of the petitioner.

4. The petitioner has made several representations seeking disbursal of his Provident Fund but the same has not been responded to by the authorities.

5. As it appear that admittedly the Provident Fund dues of the petitioner have been deposited before the Provident Fund Organization, accordingly, the instant writ petition is disposed of by directing the Regional Provident Fund Commissioner, Kolkata-I to disburse the Provident Fund dues of the petitioner at the earliest but positively within a period of eight weeks from the date of communication of this order.

6. The petitioner shall be intimated about any formalities that he is required to comply for the purpose of releasing the money in his favour.

7. The petitioner also seeks for a direction upon the Regional Provident Fund Commissioner to consider his claim for pension. A representation dated 21st August, 2024 in this regard appears to be pending.

8. The Regional Provident Fund Commissioner, Kolkata-I shall also consider the petitioner's prayer for grant of pension in his favour strictly in accordance with law at the earliest but positively within a period of eight weeks from the date of communication of this order.

9. A reasoned order as regards his prayer for pension shall be passed and communicated to the petitioner immediately thereafter.

10. Learned advocate for the petitioner is directed to forward a copy of the representation seeking consideration along with all supporting documents to the aforesaid respondent at the time of communicating the order of the Court.

11. The writ petition stands disposed of.

12. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.
