Affidavit of service filed in Court today is taken on record.

In spite service, none appears on the behalf of the private respondent (respondent no.8).

Learned advocate for the petitioner submits that the petitioner is aggrieved by the illegal construction being carried out in the adjacent building.

Mr. Mukherjee, learned advocate appears on behalf of the State.

In view of the submissions advanced by the petitioner as also the learned advocate for the State, this writ petition can be disposed of by directing the respondent no.2, being the Board of Administrators to

dispose of the representation dated 21st September, 2021 which was sent by the petitioner by registered post with acknowledgement due.

The respondent no.2 (Board of Administrators) will afford a reasonable opportunity of hearing to all the affected parties, including the respondent no.8 and thereafter consider and dispose of the representation and if required takes steps in accordance with the municipal laws. The said representation must be disposed of within a period of twelve (12) weeks from the date of communication of this order.

With the aforesaid observations, WPA 17392 of 2021 along with all connected applications stand disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
