For the Petitioner Mr. Narayan Prasad Agarwala, Mr. Ashok Das, Advocates ... ...For the State Upon considering the fact that the co-accused was enlarged on bail by the Special Court on 21st September, 2021 and that no seizure was made from the possession of the petitioner, who has also been in custody for 58 days only on the basis of the statement made by the co-accused, we are inclined to grant bail to the petitioner. The petitioner shall, however, furnish a bail bond of Rs. 10,000/- (Rupees Ten Thousand Only) along with two sureties of like amount each, one of whom shall be local to the satisfaction of learned Chief Judicial Magistrate, Malda on condition that the petitioner shall also regularly appear before the Court whenever the petitioner is required to do so and the petitioner shall also not intimidate any witness and/or tamper with evidence in any manner whatsoever. If the petitioner

defaults in respect of these conditions, the bail shall be cancelled without further reference to the Court. CRM 6867 of 2021 is allowed and disposed of on the basis of this order.
