Upon hearing learned Counsel, and considering the fact that the name of the petitioner does not feature in the seizure list and further that two of the accused, one of who features in such list, have been released on bail by the Sessions Judge, we are inclined to grant bail to the petitioner. This is despite the objection taken on behalf of the State that bail granted by the Sessions Judge was done upon misleading the Court. We do not find any reasons at least from the records to be convinced of such argument. The petitioner is directed to furnish a bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties each of like amount to the satisfaction of the Learned Additional Chief Judicial Magistrate, Haldia. The petitioner shall also regularly appear before the Magistrate whenever required to do so and shall also not intimidate witnesses or tamper with evidence till the investigation against the petitioner is complete. If the petitioner fails to comply with the aforesaid conditions, the bail shall be cancelled without further reference to this Court.
C.R.M. 6870 of 2021 is allowed and disposed of on the basis of the above.
