Mr. Ganesh Chandra Mondal ...for the petitioner Mr. Amit Kumar Nag Ms. Ranjabati Ray ....for the WBIIDC A plot of land measuring about 1292.68 sq. mtrs. in plot no. 72, J.L.No. 9, Police Station - Uluberia, District - Howrah was allotted in favour of the petitioner by virtue of a lease agreement dated January 31, 2007 by the West Bengal Industrial Infrastructure Development Corporation (in short, "WBIIDC") for building up an industry therein and possession of the land was made over to the petitioner on the same day. The allotment was terminated by the authority by a letter issued on September 14, 2022 primarily on the ground that despite being given sufficient opportunity, the petitioner failed to arrange for execution of the deed of lease and took no steps for development of the property.
The termination letter was followed by a notice of resumption issued on March 17, 2023. The petitioner is aggrieved by both the termination letter as well as notice of resumption. The petitioner seeks to file a comprehensive representation before the concerned authority in this regard and prays for a direction upon the authority to consider the representation at the earliest.
It is submitted on behalf of the WBIIDC that the representation be directed to be considered by the 3rd respondent in accordance with law.
In view of the above, the writ petition is disposed of with liberty to the petitioner to submit a comprehensive representation before the concerned authority, being the 3rd respondent herein, within two weeks from date. The 3rd respondent is directed to revisit the issue and consider and dispose of the representation within four weeks from the date of receipt thereof after affording reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law.
The petitioner is at liberty to place all relevant documents before the concerned authority at the time of hearing.
The decision taken by the authority shall be communicated to the petitioner within a week thereof. With the above observations and directions this writ petition is disposed of.
There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
