This revisional application has been preferred challenging the proceedings relating to S.C. No. 22(09) of 2021. In this case, charge-sheet was already submitted under Sections 376/417 of the Indian Penal Code. The petitioner being the complainant has alleged that certain witnesses have not been examined and statement not being recorded. Having regard to the fact that committal has already taken place two years ago and the sessions case has been registered, the petitioner would be at liberty to invoke the provisions of Section 319 of the Code of Criminal Procedure at the appropriate stage. If such an application is taken out, the learned Additional Sessions Judge, 3rd Court, Alipore would consider the same in accordance with law. With the aforesaid observations, the revisional application being CRR 2668 of 2022 is disposed of. Pending connected application, if any, is consequently disposed of.
