10.12.2021 tkm/ct 28 C.R.M. 6886 of 2021 sl no. 103 In Re : An application for bail under section 439 of the Code of Criminal Procedure in connection with Dholahat PS case no. 224/2019 dated 2.7.2019 under sections 363/365 of the IPC and subsequently charge sheet has been filed under Section 363/365/370/370A I.P.C. and section 6 of the POCSO Act.

And In Re : Sabir Molla @ Sabiruddin Molla @ Sabbir ........ petitioner Mr. A Chakraborty Mr. S S Saha ...... for the petitioner Mr. N P Agarwala Mr. Sandip Kundu ...... for the State Petitioner renews his prayer for bail and it is submitted that he is in custody for 509 days.

Learned lawyer for the State opposes the prayer for bail and submits that the petitioner is the principal accused who had kidnapped the victim girl for the purpose trafficking for sexual exploitation.

Having considered materials on record disclosing prima facie involvement of the petitioner in the alleged offence of trafficking the victim for sexual exploitation and as prayer for bail of the petitioner was rejected earlier, we are not inclined to grant bail to the petitioner.
