Mr. Tapodip Gupta ... For the Petitioner. Mr. Binoy Kumar Panda, Mr. Ivan Ray ... For the State. The petitioner says that there was no recovery from him. The allegation is that the motor car from which commercial quantity of Phensedyl syrup was recovered, belongs to him. He is in custody for eight months. Investigation is complete. Charge sheet has been filed. He seeks bail.

The State opposes the prayer for bail.

We find that the petitioner's prayer for anticipatory bail was rejected on November 20, 2023. He did not surrender thereafter. He was as large.

The State has shown us report of the Regional Transport Officer to the effect that the concerned car is registered in the name of the petitioner.

In view of the incriminating material against the petitioner and his past conduct and also keeping in mind the provisions of Section 37 of the NDPS Act, we are not inclined to entertain the petitioner's prayer for bail, at this stage. Signed By :
