2. Heard the learned advocate for the petitioner.

3. This application is filed with a prayer for direction upon the learned Judicial Magistrate, First Court at Barrakpore for disposing of Misc. Case No. 51 of 2021 expeditiously. Learned advocate for the petitioner submits that although Misc. Case No. 51 of 2021 is pending for a long period and the husband is paying interim maintenance of Rs.5,000/- per month but the case is pending for a period of 4 years for disposal.

4. In the facts and circumstances this Court is of the view that no fruitful purpose will be served by keeping this matter pending and directory service of notice. Thus, this application is disposed with request upon the learned Judicial Magistrate, First Court at Barrakpore, to dispose the Misc. Case No. 51 of 2021 pending before it within a period of 3

months from the next date fixed without granting any unnecessary adjournment. It is, however, made clear that as it is a matrimonial dispute between the parties where settlement is expected the learned Magistrate may take steps to refer the parties to mediation for the purpose of reconciliation and settlement of the disputes.
