The petitioner is working as an "Anganwadi Helper" in Anganwadi Centre no.88 in Ramrampur village. The Child Development Project Officer (CDPO), Burwan published a notice inviting applications for promotion from Anganwadi Helper to Anganwadi Worker. The petitioner was successful in the written test. The petitioner was called for written test held on April 8, 2023. Thereafter, the petitioner was called for personality test/interview on April 24, 2023.

Mr. Das, learned counsel appearing on behalf of the petitioner submits that the petitioner has come to learn that a panel is being prepared by the Staterespondents by giving preference to their favoured candidates. Apprehending such preparation of panel, the petitioner made a representation to the CDPO on

May 19, 2023. However, the said representation has not been considered till date.

Mr. Basu Mallick, learned counsel appears on behalf of the State-respondents and submits that there is no infirmity or illegality in the preparation of the panel made by the CDPO. He also submits that after participating in the selection process now the petitioner is challenging the same.

Considering the rival submissions of the parties and the materials placed on record, this Court is of the view that justice will be sub-served by directing the CDPO to dispose of the representation dated May 19, 2023 of the petitioner within 8 weeks from date. A reasoned order shall be passed and communicated to the petitioner within 2 weeks of passing thereof. With the directions aforesaid, WPA 16221 of 2023 is disposed of.

Since no affidavits have been directed to be exchanged in the writ petition, the allegations contained therein are deemed not to have been admitted by the respondents.
