Affidavit of service so filed be kept with the record. Mr. Mallick, learned advocate, appears on behalf of the petitioner and challenges the warrant of arrest so issued on 11th January, 2023 in connection with English Bazar Police Station Case No.1200 of 2022 dated 01.08.2022.

Learned advocate submits that the petitioner was earlier released on bail on 13th September, 2022, but because of his absence on 11th January, 2023, the warrant of arrest was issued against him.

Having regard to the submissions advanced that there was miscommunication between the learned advocate and the petitioner and, as such, the petitioner could not appear, I direct that in case the petitioner appears before the learned CJM, Malda by 6th September, 2023, he would be allowed to continue on the same bail and bond which was earlier granted.

The execution of warrant of arrest be stayed till 8th September, 2023. In case the petitioner do not appear on or before

the date so fixed, learned CJM, Malda would be at liberty to exhaust harsher process of law while ensuring appearance of the petitioner. With the aforesaid observations, CRR 2511 of 2023 along with CRAN 1 of 2023 is disposed of.

Pending any other applications are consequently disposed of.
